Elimination of transport controls at frontiers
The aim of this Regulation is to abolish border formalities and controls on road vehicles and their drivers, inland waterway vessels and on the corresponding documentation.
ACT
Council Regulation (EEC) No 4060/89 of 21 December 1989 on the elimination of controls performed at the frontiers of Member States in the field of road and inland waterway transport [see amending acts].
SUMMARY
Controls carried out under Community and national law on road vehicles and inland waterway vessels travelling between Member States will no longer be performed at intra-Community frontiers.
The following terms are defined in the Regulation:
"frontier" means an internal frontier within the Community or an external frontier, where carriage between Member States involves crossing a third country;
"control" means any check, inspection, verification or formality performed at the frontiers of Member States which signifies a stop or a restriction on the free movement of the vehicles or vessels concerned.
The Annexes contain references to Community and national legislation which currently provide for controls and inspections, including:
driving licence checks;
checks on documentation showing roadworthiness of motor vehicles and their trailers;
inspections to verify that technical requirements for inland waterway vessels are met;
checks on the weights and dimensions of road vehicles;
inspections of passenger lists on bus and coach services;
checks on social legislation.
